Terms of Service

1. Purpose

These Terms define the conditions under which MotionFlow AI (hereinafter "the Provider") grants the User access to its SaaS platform for AI-assisted motion design animation generation (hereinafter "the Service").

Any use of the Service implies full and unconditional acceptance of these Terms. In case of disagreement, the User agrees not to use the Service.

Access to the Service requires creating a user account. Registration is free and provides access to the Free plan.

• A valid email address is required for registration.
• The User agrees to provide accurate and up-to-date information.
• Only one account per individual is permitted.
• The User is responsible for the confidentiality of their login credentials.
• The User must be at least 16 years old (or the minimum legal age applicable in their country of residence).

4. Service description

MotionFlow AI is a SaaS platform that transforms text scripts into motion design animations using artificial intelligence. The Service includes:

• Script import: entering or importing texts to serve as the basis for generation.
• Brand Guides: creating brand guides (colors, style, tone) to customize outputs.
• Animation generation: AI analysis of the script, image and animation video generation.
• MP4 export: downloading generated animations in MP4 format.

5. Subscriptions and pricing

Subscription plans

Additional credit packs

Credit packs are single-use and not subject to renewal. Purchased credits can be used without time limit as long as the account is active.

6. Payment terms

Payments are securely processed by our partner Stripe. Accepted payment methods are credit cards (Visa, Mastercard, American Express).

• Monthly subscription: automatic charge each month on the subscription anniversary date.
• Annual subscription: annual charge with a 20% discount compared to the monthly rate.
• Prices are listed in euros, all taxes included.
• An invoice is automatically issued and accessible from your billing area.

7. Right of withdrawal

The User may nevertheless cancel their subscription at any time. Cancellation takes effect at the end of the current period.

8. Duration and termination

The subscription is taken out for a period of one month (monthly) or one year (annual), with automatic renewal.

• The User may cancel at any time from their billing area.
• Cancellation takes effect at the end of the current period. The User retains access to the Service until that date.
• No pro-rata refund is made in case of cancellation during the current period.
• After cancellation of a paid plan, the account automatically reverts to the Free plan. The User retains access to their existing projects.

The Provider reserves the right to suspend or terminate an account in case of violation of these Terms, particularly in case of abusive or fraudulent use of the Service.

9. Intellectual property

User-generated content

The User is the owner of Generated Content created through the Service. They hold all exploitation rights, including for commercial purposes, over the animations, images, and videos they produce.

Platform and brand

All elements constituting the platform (source code, interface, design, algorithms, MotionFlow AI brand, logo) are the exclusive property of the Provider and are protected by intellectual property laws.

Display license

The User grants the Provider a limited, non-exclusive, and revocable license to display Generated Content within the Service interface (preview, history, dashboard). This license is strictly limited to the operation of the Service and does not confer any commercial exploitation rights to the Provider.

10. Liability

Provider commitments

• Service availability: the Provider commits to providing a 99.5% availability rate on a monthly basis (excluding planned maintenance).
• AI content: results generated by artificial intelligence are provided "as is". The Provider does not guarantee their accuracy, relevance, or suitability for a specific use.

User commitments

The User agrees to:

• Not use the Service to generate illegal, defamatory, pornographic content, or content inciting hatred or violence.
• Not attempt to circumvent the security measures or limitations of the Service.
• Not use the Service in a way that harms its operation or that of other users.
• Respect the intellectual property rights of third parties in submitted scripts.

Limitation of liability

The Provider's liability is limited to direct damages and shall in no case exceed the total amount paid by the User during the 12 preceding months before the triggering event. The Provider shall not be held liable for indirect damages, loss of profit, data loss, or business interruption.

11. Personal data

The collection and processing of personal data are governed by our Privacy Policy, which is an integral part of these Terms.

By using the Service, the User acknowledges having read this policy and accepts the data processing described therein.

12. Applicable law

These Terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Paris.

Mediation

In accordance with Article L.612-1 of the French Consumer Code, the consumer User may use a consumer mediator free of charge for the amicable resolution of any dispute. The Provider will communicate the contact details of the competent mediator upon request.

13. Amendments

The Provider reserves the right to modify these Terms at any time. Users will be informed of any substantial modification by email at least 30 days before it takes effect.

Continued use of the Service after the modifications take effect constitutes acceptance of the new Terms. In case of disagreement, the User may cancel their subscription without penalty before the effective date of the new terms.

The applicable version of the Terms is the one in effect at the time of use of the Service, accessible at any time from the page /legal/terms.
